These Terms and Conditions ("Terms") govern your access to and use of www.ocgcompanies.com (the "Site") and any services, content, or communications offered through it by OCG Companies, LLC ("we", "us", or "our"). By accessing or using the Site, or by enrolling in any communications program we offer, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

USE OF THE SITE

You may use the Site for lawful purposes only. You agree not to use the Site to violate any applicable law, to interfere with its operation or security, to attempt unauthorized access to any system or account, or to collect information about other users without authorization. We may suspend or restrict access to the Site at any time, with or without notice.

INTELLECTUAL PROPERTY

The Site and its contents, including text, graphics, logos, and the OCG name and marks, are owned by OCG Companies, LLC or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written permission, except that you may view and print pages for your own internal reference.

TEXT MESSAGING PROGRAM

4.1 What the program is
OCG Companies, LLC operates an operational text messaging program under the program name OCG. The program sends operational and account-related text messages, and receives replies, in support of our internal business applications.

4.2 Who receives messages
Messages are sent only to our own employees and to individually authorized users of our internal business applications. The program is not offered to the general public, and we do not send text messages to consumers. Access to the applications through which enrollment occurs requires an account that we issue.

4.3 Enrollment is voluntary
Enrollment happens inside the applicable internal application, in your account notification settings. Providing a mobile telephone number is optional, and the settings form can be saved without one. To receive text messages you must also select a separate, unchecked consent checkbox that identifies OCG and discloses message frequency, that message and data rates may apply, and the STOP and HELP instructions described below.
Consent to receive text messages is never a condition of employment, and never a condition of using any of our applications. We record your consent, and either you or an administrator may remove your enrollment at any time. We do not purchase, rent, or import telephone number lists, and we do not send messages to numbers obtained from any third party.

4.4 What we send
Operational and account notifications, and our replies to messages you send us. Examples include schedule changes, crew and job assignments, and scheduled maintenance notices.

4.5 What we do not send
We do not send marketing or promotional text messages. The program is not used for advertising, and it is expressly not used for affiliate marketing or for lead generation of any kind. We do not send text messages on behalf of any third party.

4.6 Message frequency
Message frequency varies, depending on the operational activity relevant to you.

4.7 Cost
Message and data rates may apply. OCG Companies, LLC does not charge for the messages themselves; any charges are those applied by your own mobile carrier under your service plan. Consult your carrier for details.

4.8 How to stop messages, and how to get help
Reply STOP to any message at any time to stop receiving text messages. Standard opt-out keywords are honored automatically, and no further messages will be sent to your number once an opt-out is recorded. Reply HELP to any message for help.

4.9 Carriers and delivery
Mobile carriers are not liable for delayed or undelivered messages. We cannot guarantee that any message will be delivered, and delivery depends on your carrier, your device, and network conditions. Do not rely on text messaging for emergency communication.

4.10 Privacy and data sharing for the messaging program
Our handling of personal information is described in our Privacy Policy.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of data sharing described in our Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4.11 Changes to your mobile number
If your mobile telephone number changes, please update it in your account notification settings or contact us at it@ocgcompanies.com, so that messages intended for you are not sent to someone else.

The Site may link to websites we do not control. We are not responsible for the content, policies, or practices of any third-party site, and a link is not an endorsement.

DISCLAIMERS

 

The Site and its contents are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that its content is accurate or complete. Nothing on the Site is professional advice, and nothing on the Site constitutes an offer to buy or sell any service except as expressly stated in a signed agreement.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, OCG Companies, LLC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site or the messaging program, whether based in contract, tort, or any other theory, even if we have been advised of the possibility of such damages.

INDEMNIFICATION

 

You agree to indemnify and hold harmless OCG Companies, LLC and its affiliates, officers, employees, and agents from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the Site.

GOVERNING LAW AND VENUE

 

These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Oakland County, Michigan, and you consent to the jurisdiction of those courts.

CHANGES TO THESE TERMS

 

We may update these Terms from time to time. The date at the top of this page reflects the most recent version. Your continued use of the Site after a change takes effect constitutes acceptance of the revised Terms.
